Welcome to Rated Trades.ca (“Rated Trades”, “we”, “us”, “our”, or the “Platform”).
These Terms and Conditions govern your access to and use of Rated Trades.ca, including business listings, contractor profiles, reviews, ratings, verification features, memberships, search tools and any other services provided through the Platform.
By accessing or using Rated Trades.ca, creating an account, submitting a review, claiming or creating a business profile, or purchasing a membership, you agree to these Terms and Conditions.
If you do not agree with these Terms, you must not use the Platform.
1. What Rated Trades.ca is
Rated Trades.ca is an online directory, information and review platform intended to help consumers find and research tradespeople, contractors and related service businesses.
Rated Trades.ca does not perform construction, maintenance, repair or trade services on behalf of businesses listed on the Platform.
Unless expressly stated otherwise, businesses appearing on Rated Trades.ca are independent businesses and are not employees, agents, partners, representatives, subcontractors or affiliates of Rated Trades.ca.
Rated Trades.ca is not a party to any agreement entered into between a customer and a listed business.
2. No Endorsement or Guarantee
The appearance of a business on Rated Trades.ca does not constitute a recommendation, warranty, endorsement or guarantee by Rated Trades.ca.
Users are responsible for deciding whether a particular business is appropriate for their needs.
Rated Trades.ca does not guarantee:

• the quality, safety or suitability of any business or its work;

• that work will be completed correctly, safely, legally, on time or within budget;

• the accuracy of quotes, estimates or pricing;

• the availability or reliability of any business;

• the qualifications, skills or experience claimed by a business;

• that a business will maintain licences, registrations, insurance, certifications or other credentials after they have been checked; or

• that information supplied by a business or third party is complete, accurate or current.

Users should conduct their own due diligence before hiring any business.
3. Verified Businesses
Rated Trades.ca may display a Verified, Verified by Rated Trades, or similar badge or status on certain business profiles.
Verification means only that Rated Trades.ca has undertaken the verification checks specified by Rated Trades.ca at or around the time the verification was completed.
For example, Rated Trades.ca may request or review evidence relating to business registration in their operational province.
A Verified status does not mean that Rated Trades.ca guarantees, certifies or endorses the business or the quality, legality or safety of its work.
Documents, policies, registrations and other circumstances can expire, change, be cancelled or become inaccurate after verification.
Rated Trades.ca does not guarantee continuous monitoring of a business's status.
Consumers remain responsible for independently confirming any licence, insurance, registration, permit, certification or qualification that is important to the work they intend to have performed.
4. Hiring a Trade or Contractor
Any decision to contact, hire, engage, pay or enter into an agreement with a business found through Rated Trades.ca is made entirely at the user's own discretion and risk.
Rated Trades.ca is not responsible for:

• workmanship;

• defective or incomplete work;

• delays;

• abandoned projects;

• property damage;

• personal injury;

• financial loss;

• incorrect estimates or invoices;

• deposits or payments;

• warranties;

• contractual disputes;

• insurance claims;

• building code compliance;

• permits or inspections;

• licences or certifications;

• health and safety compliance;

• employee or subcontractor conduct;

• theft or loss;

• misrepresentation; or

• any other act or omission of a business listed on the Platform.

Any contract for services exists solely between the customer and the business they engage.
5. Quotes, Contracts and Payments
Rated Trades.ca is not responsible for negotiating, reviewing, approving or enforcing agreements between users and businesses.
Users should obtain appropriate written quotes, contracts, warranties and payment terms directly from the business.
Unless Rated Trades.ca expressly provides a payment service in the future, Rated Trades.ca does not process or control payments between customers and businesses and accepts no responsibility for deposits, refunds, outstanding balances, payment disputes or financial losses arising from such transactions.
6. Reviews and Ratings
Rated Trades.ca allows users to submit ratings and reviews regarding businesses.
Reviews represent the views and experiences of the individual reviewer and do not represent the views of Rated Trades.ca.
Rated Trades.ca does not guarantee that every review is accurate, complete or representative of every customer's experience.
Users submitting reviews must provide honest information based on genuine experiences.
Reviews must not contain knowingly false or misleading information, threats, harassment, discriminatory content, unlawful material, spam or content unrelated to the business being reviewed.
Rated Trades.ca reserves the right, but is not obligated, to review, approve, reject, edit, hide or remove submitted content where permitted by law and consistent with our moderation policies.
7. Business Profiles
Businesses are responsible for ensuring information appearing on their profiles is accurate and current.
This includes, where applicable:

• business name;

• contact details;

• service areas;

• services offered;

• photographs;

• website information;

• insurance information;

• registration information;

• licences and qualifications; and

• other profile information.

Rated Trades.ca accepts no responsibility for losses or damages resulting from inaccurate, outdated or incomplete business information.
8. Claiming a Business Profile
Rated Trades.ca may allow eligible users to claim existing business profiles.
By claiming a profile, you represent that you are authorized to act on behalf of that business.
Rated Trades.ca may request evidence of ownership, employment or authorization and reserves the right to refuse, reverse or remove a profile claim where appropriate.
Unauthorized claiming of another person's or business's profile is prohibited.
9. Business Memberships
Rated Trades.ca may offer free, premium, featured or other membership levels.
Features, pricing and benefits may vary between plans and may change from time to time.
Paid memberships provide access to the features described at the time of purchase. Purchasing a membership does not guarantee enquiries, leads, customers, revenue, search position or business success.
Where memberships renew automatically, applicable pricing and renewal information will be disclosed during purchase.
Annual Subscription Your Rated Trades Premium subscription will automatically renew each year unless cancelled before your next renewal date. You can cancel your subscription at any time from your account. Your Premium benefits will remain active until the end of your current paid billing period.

Cancellation does not necessarily entitle the member to a refund for amounts already paid, except where required by law or expressly stated otherwise.
10. Search Results and Rankings
Rated Trades.ca may determine the order in which businesses appear in search results using factors such as location, service area, membership level, verification status, ratings, review count, relevance, featured status or other criteria.
Search position is not a guarantee of quality.
A business appearing higher in search results should not automatically be interpreted as being better, safer or more suitable than another business.
11. User Responsibilities
Users are responsible for exercising reasonable judgment when using Rated Trades.ca.
Before hiring a contractor or trade, users should independently consider checking matters relevant to the proposed work, including insurance, business registration, licences, qualifications, references, contracts, permits and applicable regulatory requirements.
Rated Trades.ca should be used as one source of information, rather than as a substitute for a user's own due diligence.
12. Prohibited Use
Users must not use Rated Trades.ca to engage in unlawful, fraudulent, deceptive, abusive or harmful conduct.
Users must not attempt to manipulate ratings or reviews, submit fake reviews, impersonate another person or business, claim a business without authority, scrape or misuse Platform data, interfere with Platform operation or use Rated Trades.ca in a way that infringes the rights of another person or business.
We reserve the right to suspend or terminate accounts, remove content or restrict access where we reasonably believe these Terms have been violated.
13. Third-Party Websites and Services
Rated Trades.ca may contain links to businesses, websites, maps, social media platforms, payment providers or other third-party services.
Rated Trades.ca does not control those third parties and is not responsible for their content, availability, security, privacy practices, products or services.
Accessing third-party services is at the user's own risk and may be subject to separate terms and policies.
14. Platform Availability
We aim to provide a reliable service but do not guarantee that Rated Trades.ca will always be available, uninterrupted, secure or error-free.
We may modify, suspend, restrict or discontinue any portion of the Platform at any time.
We are not responsible for losses arising from outages, technical problems, data loss, software errors, cyber incidents or temporary or permanent unavailability of the Platform, except to the extent liability cannot lawfully be excluded.
15. Limitation of Liability
To the fullest extent permitted by applicable law, Rated Trades.ca, its owners, operators, directors, employees, contractors, representatives and affiliates will not be liable for any loss, damage, injury, claim, cost or expense arising from or relating to:
the use of Rated Trades.ca;
the inability to use Rated Trades.ca;
reliance on information appearing on the Platform;
a decision to contact, hire or not hire a business;
services or work performed or not performed by a listed business;
the conduct of any customer, contractor, trade, business or other third party;
reviews, ratings or other user-generated content;
verification information or changes occurring after verification; or
any transaction, agreement, dispute, injury, property damage or financial loss involving a user and a listed business.
To the fullest extent permitted by law, Rated Trades.ca will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, loss of profits, loss of business, loss of opportunity, loss of data or similar losses.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
16. No Professional Advice
Information provided through Rated Trades.ca is for general informational purposes.
Rated Trades.ca does not provide legal, engineering, architectural, accounting, insurance, building-code, safety or other regulated professional advice.
Users should obtain appropriate professional advice where required.
17. Indemnification
To the extent permitted by law, users and businesses agree to indemnify and hold harmless Rated Trades.ca and its owners, operators, directors, employees, contractors and representatives from claims, liabilities, losses, damages, costs and reasonable legal expenses arising from their misuse of the Platform, violation of these Terms, content they submit, services they provide, or infringement of another person's rights.
18. Intellectual Property
The Rated Trades.ca name, branding, logos, website design, original content, databases and other proprietary materials are owned by or licensed to Rated Trades.ca unless otherwise stated.
Users may not reproduce, copy, distribute, commercially exploit or create unauthorized derivative works from Rated Trades.ca content without permission, except where permitted by law.
Businesses retain appropriate rights to materials they submit but grant Rated Trades.ca the permissions reasonably necessary to display and use those materials in operating and promoting the Platform.
19. Privacy
Use of personal information through Rated Trades.ca is governed by our Privacy Policy.
By using the Platform, users acknowledge that personal information will be handled in accordance with that policy and applicable Canadian privacy requirements.
20. Removal or Suspension of Listings and Accounts
Rated Trades.ca reserves the right, subject to applicable law, to suspend, restrict, modify or remove accounts, listings, reviews or other content where reasonably necessary to operate or protect the Platform, enforce these Terms, address suspected fraud or abuse, comply with legal requirements, or protect users or third parties.
21. Changes to These Terms
Rated Trades.ca may update these Terms and Conditions from time to time.
The updated version will be posted on the Platform with a revised “Last Updated” date.
Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms to the extent permitted by law.
22. Governing Law
These Terms and Conditions are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada.
Subject to applicable consumer protection laws and other mandatory legal requirements, disputes relating to these Terms or Rated Trades.ca will be subject to the jurisdiction of the courts of British Columbia.
23. Severability
If any provision of these Terms is determined to be invalid, unlawful or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
24. Entire Agreement
These Terms, together with the Privacy Policy and any additional terms expressly applicable to a particular Rated Trades.ca service, constitute the agreement between the user and Rated Trades.ca concerning use of the Platform.
